ISSUE Whether the National Industrial Court works at the pace of any of the parties in a case before it. FACTS The Applicant applied for the interpretation of certain provisions of a collective agreement between the Applicant and the 2nd Respondent. When the matter came up on 1st June, 2004, counsel for the Respondent prayed the court to enter the terms of settlement filed as the judgment of the court. However, the Assistant Secretary-General of the Applicant informed the court that notwithstanding the said terms of settlement the matter was yet to be settled completely, and urged the court for a short adjournment to enable the Applicant consult her counsel, which was granted. Between P June, 2004 to and 3t February, 2005 there were four adjournments without the Applicant indicating whether the matter had been settled completely.
