ISSUE Whether an Applicant can withdraw his suit notwithstanding non-compliance with rule 21 of the National Industrial Court Rules. FACTS The Applicant filed an application by way of motion on notice for the enforcement of judgment of National Industrial Court. When the matter came up on 25th May, 2004, counsel to the Applicant applied to wit the suit under rule 21 of the National Industrial Court Rules. HELD: (‘Striking out the suit): On Whether an applicant will be granted leave to withdraw suitfrom National Industrial Court notwithstanding non-compliance with rule 21 thereof - By virtue of rule 4 of the National Industrial Court Rules, an Applicant will be granted leave to withdraw his suit, notwithstanding non-compliance with rule 21 of the Rules of the court.
