ISSUE Whether the Applicant’s application for stay of execution of judgment of the National Industrial Court deserves to be granted. FACTS The Applicant applied to the National Industrial Court seeking injunction restraining the Respondent from giving effect to the judgment of the National Industrial Court delivered on 28 January, 2004 pending the determination of the appeal at the Court of Appeal, and an order to maintain status quo pending the determination of the said appeal. The Respondent filed a counter affidavit to the application and opposed same. HELD: (Dismissing the application): On Whether National Industrial Court will grant application for stay of execution, which does not fulfill requirements of section 20 of the Trade Disputes Act - Where, as in this case, an application for stay of execution of judgment of the National Industrial Court does not fulfill the requirements of section 20 of the Trade Disputes Act, the National Industrial Court will not grant such an application. Accordingly, the National Industrial Court refused the application in this case.
