DADDA - MEMBER SUITNO: - NIC/17M/2003 DATE OF JUDGMENT - NATIONAL INDUSTRIAL COURT Injunction - Order of - When National Industrial Court will grapending not appeal before it - Terms it may impose. ISSUE Whether the National Industrial Court ought to grant the injunction sought by the Applicant pending the appeal before it. FACTS The Applicant applied to the National Industrial Court for an interim order directing the Respondent to stay actions relating to the subject matter of the award of the Industrial Arbitration Panel, particularly the conference scheduled for 11th December, 2003, pending the determination of the Applicant’s appeal to the National Industrial Court. The Respondent counsel, who sought adjournment for the purpose of being properly briefed, did not oppose the application on the condition that the Applicant indemnified the Respondent against damages arising from the grant of the order sought. Held: (Granting the application): On When National Industrial Court may grant injunction pending determination of appeal before it - In appropriate cases, the National Industrial Court will grant injunction to preserve the subject matter of an appeal before it, pending the determination of such appeal. Consequently, the court granted the injunction sought by the Applicant against the Respondent, but ordered the Applicant to indemnify the Respondent in the event of any damage arising from the order so granted.
