NATIONAL INDUSTRIAL COURT Arbitral award - Application in respect of to the National Industrial Court – Whether National Industrial Court can entertain without reference of award to it. ISSUE Whether the court has jurisdiction to entertain the Applicants’ application. FACTS The Applicants, by a way of a motion on notice, applied to the National Industrial Court for an order staying proceedings of the Industrial Arbitration Panel in Trade Dispute No IAPIL.501/95 in the application brought for the enforcement of the award pending the determination of the appeal lodged in the court. The court considered the affidavit of both parties to resolve the application. HELD: (Striking out the application): On Whether the National Industrial Court has jurisdiction to entertain an application where the award subject matter of the application has not been referred to the court – The National Industrial Court has no jurisdiction to entertain an application where the award of the Industrial Arbitration Panel, which is the subject of the application, has not been referred to the court by the Minister of Labour and Productivity.
