ISSUE: What is the true meaning and intendment of the 3 paragraph of page 26 of the judgment of the court delivered on 6th day of May, 1993? FACTS: The Applicant, by originating summons dated 1st November, 1993, sought interpretation of the judgment of the National Industrial Court delivered on 6th May, 1993. The application was supported by a six-paragraph affidavit. The affected portion of the said judgment reads: “All check-off dues in respect of junior employees in the Aviation Industry shall continue to be paid to the National Union of Air Transport Services Employees, similarly, check-off dues in respect of Senior Employees in the Aviation Industry who have accepted in writing to make voluntary contributions to the Association, shall be paid by the employer in the Industry to the Air Transport Services Senior Staff Association of Nigeria “. HELD: (Dismissing the application): On When National Industrial Court will refuse application for interpretation of its judgment - Where the judgment of the National Industrial Court is clear and unambiguous, an application for the judgment to be interpreted by the court will be refused. Moreover, the position in the judgment is clearly stated in a statutory provision.
