LABOUR LAW Termination of appointment - Workers who took part in meeting without employer’s permission - Summary termination of appointments of- Severity of- Whether proper. ISSUE: Whether the termination of the affected workers in the circumstances was not wrongful. FACTS: The Respondent summarily terminated the appointments of seven (7) of her employees on of taking part in a meeting without prior permission of the Respondent. Appellant union to which the seven workers belonged therefore declared a trade dispute. The Industrial Arbitration Panel heard the matter and made a “no award”. The Appellant was dissatisfied and appealed to the National Industrial Court. HELD: (Allowing the appeal and granting severance pay): On whether summary termination proper punishment for workers who took part in an illegal meeting - Summary termination of appointments of workers, who took part in a meeting held in their employer‘s premises without prior permission, is too severe a punishment. In the instant ne court ordered financial compensation for each of the seven workers by way of severance pay.
