NATIONAL INDUSTRIAL COURT Terms of settlement - Circular letter attached thereto - Contents of- Whether court can order parties to implement. ISSUE: Whether the court has powers to order parties before it to implement the contents of j circular letter attached to the terms of settlement signed by both parties. FACTS; The parties had a dispute, which was referred to the Industrial Arbitration Panel by Commissioner for Labour. The dispute concerned two matters, viz: retirement benefit including gratuities and pensions; and industrial action by the workers. The Appellant la j withdrew the second item after the workers had resumed their normal duties. The IAP then made its Award on the 1st item. The Appellant appealed against the Award raising a number of grounds of objection. When the hearing of the Appellants objection commenced on 15th January, 1980, Counsel for the respondent informed the court that the Oyo State Government had taken over the Hospital r: m the Medical Board and that as a result of the new development, all Voluntary Agency Hospitals (including Mission Hospitals) held a meeting with officials of Oyo State Ministry of Health on 27th December, 1979, to sort out the conditions of service for their workers. Later both parties filed a final terms of settlement duly signed by both parties, wherein both parties agreed that Appendix "A" to their joint agreement, which was a Permanent Secretary, Federal Ministry of Establishments' circular letter, be made the judgment of the HELD: (Entering the terms of settlement between the parties as judgment of the court): On Power of court to order parties before it to implement contents of circular letter which juries agreed should be made judgment of court- The court can order parties before it to implement the contents of a circular letter, which both parties have agreed, should be made the judgment of the court.
